Mandatory Arbitration Provisions (US Residents)
Agreement to Arbitrate
US residents and Product School agree to resolve claims relating to terms or services through final binding single-arbitrator arbitration, except as noted in the exceptions below.
Opt-Out
Users may opt out within 30 days of agreeing to arbitration-containing terms by emailing support@productschool.com.
Procedures
American Arbitration Association administers arbitration under Commercial Arbitration Rules and Consumer Related Disputes Supplementary Procedures in San Francisco County, California, or agreed locations.
Fees
AAA rules govern arbitration fee payment. Product School will not seek attorneys’ fees/costs unless arbitrators determine claims frivolous.
Exceptions
Small claims court claims in San Francisco County or users’ residence/work counties, or injunctive relief suits for unauthorized use or intellectual property infringement proceed without arbitration.
No Class Actions
You may only resolve disputes with us individually. That is, you may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
Severability
If the “No Class Actions” provision is found unenforceable, the entire arbitration section is void. Non-waivable specific claims/relief requests arbitrators lack authority for may proceed in court with stayed litigation pending other arbitration-resolved claims/requests.
